1. Overview
This website is operated by Myers Milk Co. Throughout the site, the terms “we,” “us,” and “our” refer to Myers Milk Co. We offer this website—including all information, tools, products, and services available from it—to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our Service and agree to be bound by the following Terms & Conditions (“Terms of Service,” “Terms”), including any additional terms and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and content contributors.
Please read these Terms carefully before accessing or using our website. By accessing any part of the site, you agree to be bound by these Terms. If you do not agree to all terms and conditions, you may not access the website or use any services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.
Any new features or tools added to the current store shall also be subject to these Terms. You may review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of the site after changes are posted constitutes acceptance of those changes.
2. Policies
2.1 Account Creation & Payment Information
- Customers must provide a valid credit or debit card to begin receiving service.
- It is the customer’s responsibility to notify us of any card changes, including expired, canceled, lost, or replaced cards.
- We do not accept checks.
- A non-refundable registration fee of $35.00 will be assessed when creating a new customer account.
2.2 Delivery Holds Due to Unpaid Balances
We will not make a delivery if you have an unpaid balance. Your account will be suspended until the balance is cleared.
2.3 Pre-Delivery Billing
We reserve the right to bill your credit card the day before delivery for purchases of any amount.
3. Billing & Payment Failures
To maintain uninterrupted service, customers must keep a valid payment method on file. If a customer’s card is declined for any reason—including insufficient funds, expiration, cancellation, or bank restrictions—Myers Milk Co. reserves the right to immediately suspend the account.
During suspension:
- No deliveries will be made until a valid payment method is provided.
- Customers must update payment information and notify Myers Milk Co. once the issue is corrected.
- We are not required to deliver, hold, or reserve products while payment issues remain unresolved.
Service will resume on the next eligible delivery day after updated payment information is received and confirmed.
4. Delivery Policies
4.1 Delivery Times & Weather Delays
We strive to deliver orders before 7:00 p.m. Delivery times may be later due to weather or unforeseen circumstances.
If you do not receive your order on your scheduled day—or receive a product that is missing or unsatisfactory—you must contact us within 24 hours. After 24 hours, replacements or refunds cannot be issued.
4.2 Ongoing Deliveries
Deliveries will continue at your selected frequency until you notify us of changes.
Note: There is no “submit” button for orders. Items in your cart at the cutoff time automatically process as an order.
4.3 Changing Account Information or Orders
- All account changes must be made through our website or by speaking with a team member by phone.
- Order changes must be made 72 hours prior to your delivery day.
- If changes are made after the deadline and the website accepts them, there is no guarantee they will be honored.
4.4 Delivery Days
We deliver Monday through Saturday. We will assign your delivery day(s) and reserve the right to change them with seven days’ notice, provided via our website and possibly email.
4.5 Account Cancellation
There is no long-term commitment.
To cancel your account, you must contact us by email or phone before the cutoff deadline for your next delivery. Late cancellations are responsible for any items delivered.
4.6 Delivery Conditions
You do not need to be home during delivery. Please leave your porch box or cooler outside your front door.
- If temperatures exceed 70°F, include freezer packs or ice.
- If temperatures fall below 35°F, place a towel in your porch box or cooler.
5. Billing Questions & Discrepancies
If you experience any billing discrepancies, please contact us for prompt resolution.
5.1 Billing Schedule
All billing is processed the day before delivery.
5.2 Failed Payment Fees
- All failed credit card transactions incur a $0.50 fee, including those caused by expired, lost, or stolen cards.
- If a payment fails, we will reattempt every 24 hours for two weeks; each failed attempt incurs another $0.50 fee.
- Orders left unpaid for 15 calendar days will incur a 2.5% late fee, with an additional 2.5% added on the first of every month thereafter until paid.
6. Delivery Liability
Drivers are not responsible for relaying messages to the office.
Once your order has been delivered, all products are no longer considered property or responsibility of Myers Milk Co.
We do not cover costs for items that spoil, break, melt, freeze, or are stolen after delivery.
7. Glass Jar Policy
Myers Milk Co. provides glass jars and lids for milk storage at a fee of $5.00 per jar and lid.
Customers are responsible for:
- Cleaning jars and lids
- Returning them at the next pickup with their name written on a small piece of paper placed inside the jar
If jars are not returned for reuse, you agree to pay the $5.00 replacement fee.
A $5.00 replacement fee will also be charged for any jar or lid that is broken, unclean, unreturned, or otherwise unusable.
Returning clean jars and lids is a condition of this agreement.
8. Herdshare Fee
A non-refundable $35.00 Herdshare Fee will be charged for adding a herdshare to a customer’s account.
9. Acceptance of Terms
By registering for our service, you acknowledge that you have read, understood, and agree to all Terms & Conditions listed above.
10. Payment Methods & Processing Fees
Myers Milk Co. accepts credit card and ACH (bank transfer) payments only. We do not accept cash or checks at this time.
10.1 Credit Card Payments
All credit card transactions are subject to a 2.99% processing fee plus $0.30 per transaction.
10.2 ACH Payments
All ACH transactions are subject to a 0.50% processing fee.
10.3 Authorization
By maintaining an active account with Myers Milk Co., you authorize us to charge your chosen payment method—including applicable processing fees—for all orders, charges, and fees associated with your account.
